Amendments to the Regulation on the Procedure for Licensing the Import of Goods

In order to liberalize and unify the procedure for issuing licenses for the import of goods, the Ministry of Economy has developed a draft order of the Ministry of Economy "On Amendments to Certain Regulatory Acts of the Ministry of Economy of Ukraine" (hereinafter - the draft order).

The Draft Order proposes to bring the procedure for licensing the import of goods in line with the Resolution of the Cabinet of Ministers of Ukraine No. 1402 dated 27.12.2023 "On Approval of the Lists of Goods Subject to Licensing and Quotas for 2024" (as amended), the Law of Ukraine "On Regulation of Economic Activity with Ozone Depleting Substances and Fluorinated Greenhouse Gases", and other legislative innovations, in particular in the field of digitalization.

The Draft Order (in the previous wording "On Amendments to the Order of the Ministry of Economy of Ukraine dated September 14, 2007 No. 302") has been finalized in accordance with the comments and suggestions of the State Regulatory Service of Ukraine and the Ministry of Environmental Protection and Natural Resources of Ukraine.

The Draft Order provides for:

♦ submission of documents by applicants and obtaining the License in electronic form through the information system of the Ministry of Economy of Ukraine or through the Unified State Web Portal of Electronic Services;

♦ reduction of the list of documents to be submitted by the applicant for obtaining the License, clarification of the procedure for their submission, clarification of the procedure for obtaining the License;

♦ determining the procedure for obtaining approval for import of goods from central executive authorities through the system of electronic interaction of executive authorities in cases determined by the Government of Ukraine;

♦ submission by the applicants of the payment order or information on payment in electronic form;

♦ issuance of the License in the presence of information on the fact of payment in the relevant software products;

♦ abolition of irrelevant provisions of the Order No. 991 (regarding the standardized serial number of the license for export of goods);

♦ bringing the terminology of Order No. 302 in line with the current legislation.

In particular, paragraph 2 is set out in the following wording.

In order to obtain a license, an applicant - a foreign economic activity entity - shall submit the following documents:

♦ an application for a license to import goods in the form approved by Order of the Ministry of Economy No. 302 dated September 14, 2007 (hereinafter referred to as the "license application")

♦ a letter of application for the license with the contact phone numbers; e-mail address; surname, name, patronymic (if any) and position of the applicant or his/her authorized contact person;

♦ copies of the foreign economic agreement (contract), all specifications, annexes, additional agreements and other documents that are integral parts of the agreement (contract), certified in accordance with the procedure established by law. If such documents are in a foreign language, the applicant shall attach their translation into Ukrainian.

The documents may be submitted in one of the following ways at the applicant's option

  • in paper form - in person (by hand) or by mail with a list of attachments;
  • in electronic form through the information system of the Ministry of Economy of Ukraine (hereinafter referred to as the Ministry of Economy's Electronic Services Portal), by means of the Unified State Web Portal of Electronic Services (if technically possible) using an electronic signature based on the applicant's qualified electronic signature certificate.
