The State Labor Service will be able to conduct inspections on mobbing

On February 28, 2024, the Verkhovna Rada registered Draft Law No. 11044 "On Amendments to Article 16 of the Law of Ukraine "On Organization of Labor Relations under Martial Law" regarding inspections in terms of mobilization".

The authors of the draft law recall that the state's being in a state of war and the activities of employees under the threat of hostilities required a significant revision of the system of organization of labor relations under martial law. In this regard, the Law of Ukraine "On the Organization of Labor Relations under Martial Law" was adopted, which prohibits unscheduled state supervision (control) in the labor sphere, except in certain cases.

At the same time, in 2023, the State Labor Service and its territorial bodies received 553 appeals regarding signs of mobbing. Therefore, there is a need to amend the legislation and expand the list of cases in which unscheduled state supervision (control) measures can be taken during the legal regime of martial law.

Therefore, the draft law proposes to establish that during the period of martial law, the central executive body implementing the state policy on supervision and control over compliance with labor legislation and its territorial bodies may, at the request of an employee or trade union, carry out unscheduled measures of state supervision (control) over compliance with labor legislation by legal entities, regardless of ownership, type of activity, business, and individuals using hired labor, in terms of compliance with the requirements of this law.

The text of the draft law stipulates that it will come into force on the day following the day of its publication.
