Amendments to the Procedure for Registration of Real Property Rights
On March 12, 2024, Resolution of the Cabinet of Ministers of Ukraine No. 239 "On Amendments to the Procedures Approved by the Resolutions of the Cabinet of Ministers of Ukraine No. 1127 dated December 25, 2015 and No. 637 dated June 16, 2021" (hereinafter - the Resolution) came into force.
The Resolution amended the following
- The Procedure for State Registration of Real Property Rights and Encumbrances, approved by Resolution of the Cabinet of Ministers of Ukraine No. 1127 "On State Registration of Real Property Rights and Encumbrances" dated 25.12.2015 and
- the Procedure for verifying the compliance of the acquirer or owner of an agricultural land plot with the requirements set forth in Article 130 of the Land Code of Ukraine, approved by CMU Resolution No. 637 of June 16, 2021.
The main changes provided for by the Resolution:
- the list of documents to be submitted for state registration of ownership in connection with the transfer of property to the ownership of a legal entity as a contribution (contribution of property to the authorized (share) capital (authorized capital), entrance, membership and targeted contributions of members of a cooperative, etc.) and for state registration of ownership in connection with the transfer of property to individuals and legal entities as a result of termination (liquidation or reorganization) of a legal entity or spin-off of a new legal entity from it is supplemented by a protocol for conducting an inspection of the acquirer of land
- the authenticity of signatures on a written application of individuals or legal entities to whom the real estate of a legal entity that is being terminated has been transferred, on the distribution of such property among them, is certified in accordance with the Law of Ukraine "On Notaries".
