The Cabinet of Ministers plans to amend the rules for fuel storage

The Ministry of Economy has published a draft resolution of the Cabinet of Ministers of Ukraine "On Amendments to Clause 1 of Resolution of the Cabinet of Ministers of Ukraine No. 314 of March 18, 2022" on its website.

The need for the amendments arose due to the obligation of many business entities to use fuel-fired power generating units.

Given the aggravated situation in some regions of our country and the risks of long-term blackouts, deterioration of logistics, possible fuel shortages (due to deterioration of logistics), as well as to ensure proper living conditions for the population, there is a need to increase the volume of fuel up to 10,000 liters that can be stored at one facility for servicing power generating units without obtaining permits and without registering an excise warehouse.

The Draft Resolution proposes to establish that during the period of martial law and within 30 days from the date of its termination or cancellation

► storage by business entities operating in the territories where hostilities are taking place, territories where hostilities are possible and occupied territories, as defined by the order of the Ministry of Reintegration, of fuel consumed for refueling an electric generator set in a volume not exceeding 10,000 liters at each facility equipped with an electric generator set is carried out without obtaining permits, and the storage of fuel in excess of 10,000 liters at each facility equipped with an electric generator set is carried out on the basis of a free of charge submission to the territorial bodies of the State Tax Service of a declaration on the conduct of economic activity on fuel storage (hereinafter - the declaration on fuel storage);

► for business entities operating in the territories where hostilities are taking place, territories where hostilities are possible and occupied territories, as defined by the order of the Ministry of Reintegration, a premise or territory, including a payer of the excise tax on the sale of fuel, in each of which the total capacity of the located tanks for storing fuel used exclusively for refueling electric generator sets does not exceed 10,000 liters, will not be considered an excise warehouse.

In addition, it is proposed to define the requirements for the fuel storage declaration, in particular, the information to be contained in such a declaration and the method of its submission, and to determine the responsibility for fuel storage in the absence of a properly submitted fuel storage declaration.
