How the Unified Register of Debtors works

The Unified Register of Debtors is a systematized database of debtors that is part of the automated enforcement system and is maintained to provide everyone with real-time information on the debtors' outstanding property obligations.

Information on debtors included in the Unified Register of Debtors (URD) is public and is available on the official website of the Ministry of Justice of Ukraine at https://erb.minjust.gov.ua.

The registration of a debtor in the Unified Register of Debtors does not exempt it from enforcement.

One debtor may have several enforcement proceedings for debt collection. All this information will be displayed in the search engine of the Register.

The Unified Register of Debtors contains the following information

- surname, name, patronymic (if any), date of birth of the debtor - an individual or name, identification code of the legal entity in the Unified State Register of Legal Entities, Individual Entrepreneurs and Public Organizations of the debtor - a legal entity

- name of the body or surname, name, patronymic and position of the official who issued the enforcement document;

- name of the state executive service body or surname, name, patronymic of the private executor, number of the means of communication and e-mail address of the executor;

- number of the enforcement proceedings;

- category of recovery (alimony, fine, etc.).

State bodies, local self-government bodies, notaries, and other entities, in the exercise of their administrative functions in accordance with the law, in the event that a person applies for a certain action with respect to property belonging to a debtor entered in the URB, must notify the state enforcement service or private enforcement officer specified in the URB no later than the next business day, indicating the information about the property in respect of which such person has applied.

In case of opening an account in the name of an individual entered in the URB, including through separate subdivisions of the bank, or closing an account by such an individual, banks are obliged to notify the state enforcement service or private enforcement officer specified in the URB on the day of opening or closing the account.

No later than the next business day after receiving the notification, the enforcement officer shall decide to seize the property and/or funds in the debtor's bank accounts.

This procedure is set out in Article 56 of the Law of Ukraine "On Enforcement Proceedings", unless such property has already been seized on the same grounds.

The conclusion of a transaction with respect to the debtor's property, which resulted in the inability to satisfy the creditor's claims at the expense of such property, is grounds for invalidating the transaction.

Information about the debtor is entered into the URB (except for information about debtors such as state bodies, local governments, as well as debtors who do not have debts under an enforcement document for the collection of periodic payments for more than three months, and debtors under a non-property decision) simultaneously with the issuance of a resolution on the opening of enforcement proceedings.

Information about a debtor under a decision to establish visitation with a child and to remove obstacles to visitation with a child is entered into the URB simultaneously with the issuance of a decision to impose a fine on the debtor.

Information about the debtor is excluded from the URB simultaneously with the issuance of a resolution on the termination of enforcement proceedings, return of the enforcement document to the creditor pursuant to paragraphs 1, 3, 11 of part one of Article 37 of the Law of Ukraine "On Enforcement Proceedings" or return of the enforcement document to the court pursuant to Article 38 of the Law of Ukraine "On Enforcement Proceedings" or on the day the enforcement officer establishes that there is no debt under enforcement documents for the recovery of periodic payments.
