Product characterization checks for all types of non-food products have been resumed: what fines face businesses

MP Nina Yuzhanina notes that the Government has decided to restore state market surveillance measures in all areas of state market surveillance and control of non-food products in relation to all types of non-food products.

The state market surveillance measures include, in particular:

► verification of product characteristics, sampling of products and their examination (testing) (includes scheduled and unscheduled inspections)

Restrictive (corrective) measures, including:

♦ restriction of products on the market;

♦ prohibition of placing products on the market;

♦ withdrawal of products from the market

Recall of products.

"The text of the resolution is not yet available, and the date of resumption has not been announced.

I would not be surprised if it is January 1, 2025.

I would like to remind you that since 2022, scheduled state market surveillance measures have been suspended for the period of martial law, except for measures to ensure that certain products comply with the requirements of certain technical regulations," the MP emphasizes.

Scheduled inspections of product characteristics for all types of non-food products will resume.

Penalties that may be imposed:

♦ for failure to comply with the storage conditions by the distributor, if as a result the products became dangerous and/or do not meet the established requirements - UAH 34 thousand (UAH 17 thousand for single tax payers), and for a repeated violation within three years - UAH 68 thousand

♦ for placing on the market products that pose a serious risk - UAH 102 thousand, and for repeated violation within three years - UAH 340 thousand

♦ for placing on the market products that do not meet the established requirements - from UAH 34 thousand to UAH 51 thousand, for a repeated violation within three years - UAH 68 thousand.

Fines ranging from UAH 17 thousand to UAH 170 thousand are also imposed for failure to comply with a decision to take restrictive (corrective) measures or to allow inspections.
